10.01 Special provisions apply to certain types of agricultural holding – notably Market Gardens, Smallholdings and Allotments – for instance as regards compensation on termination of the tenancy.
If land is let on or after 1 September 1995, it may have been let as a farm business tenancy. In the case of small holdings and allotments, land that is let on a farm business tenancy is excluded from the special compensation provisions (described below) that apply to both allotments and small holdings.1 In such cases, compensation on termination will be governed by the rules in Part III of the Agricultural Tenancies Act 1995,2 and not by those in the Allotment Acts.
