5.53 The 1986 Act expressly excluded from its protective provisions certain short-term arrangements, principally grazing and mowing agreements, and agreements granted with Ministry consent.
These interests cannot be granted under the 1986 Act on or after 1 September 1995. The old law remains important, however, in evaluating the legal status of short-term arrangements entered into before 1 September 1995, as failure to observe the terms on which exclusion from the 1986 Act was available may have led to the creation of a fully protected tenancy.
