10 Arbitration on the terms of the new tenancy
8.99 At any time between the giving of the Tribunal’s direction and the end of three months from the date specified in the retirement notice as the date on which succession is to take place, either party may apply for arbitration as to the terms of the new tenancy.168 The provisions as to arbitration set out in s 48 of the 1986 Act apply, in the same way as they do where succession takes place on the death of the tenant. Note that where retirement occurs, a demand for arbitration must normally be made within three months of the retirement date.
