6 Eligibility for succession
8.17 To be an ‘eligible person’ the applicant must not only be a close relative of the deceased (above) but also satisfy two further eligibility conditions,40 viz:
(i)The ‘livelihood condition’
8.18 In the seven years ending with the date of death, his/her only or principal source of livelihood throughout a continuous period of not less than five years, or two or more discontinuous periods together amounting to not less than five years, must have been derived from his/her agricultural work on the holding, or an agricultural unit of which the holding forms part; and
(ii)The commercial unit ‘occupancy’ condition
8.19 S/he must not be the occupier of a commercial unit of agricultural land.
