2 Enlargement of notice to quit
7.42 Where notice to quit part is given by a person entitled to a severed part of the reversionary estate, or where it is validated by s 31 (above), s 32 gives the tenant the right to ‘treat’ the notice as notice to quit the whole holding. To do so he must give a written counter notice within 28 days to the landlord, or to the several owners of the reversionary estate, stating that he accepts the notice to quit as a notice to quit the entire holding, to take effect at the same time as the original notice. This right does not apply, however, if notice to quit part is given pursuant to a power contained in the contract of tenancy.
