3 Severance of Reversion

4.08 Where the freehold reversion on the tenancy is severed (for instance by the sale of part of the freehold by the original landlord), each of the landlords of the severed parts has the right to serve notice to quit that part.

The tenant who receives notice to quit from the landlord of a severed portion of the reversion is entitled, however, to opt to quit the whole holding by serving notice to quit on the other reversioners within one month.15 By virtue of s 5(3) of the 1995 Act, a notice of termination given by one reversioner to prevent the continuance of a fixed term under the Act will be taken to be a notice to quit for these purposes. This will entitle the tenant to serve notice to terminate the tenancy on the other reversioners, provided he does so within one month of himself receiving notice of termination. This will enable him to prevent the continuation of the tenancy after the term date in relation to the whole holding, where he has only been given notice of termination in relation to part of the holding by one reversioner.
