4 Subtenants
11.37 Subtenants are protected by s 9 of the 1976 Act. Broadly, where a statutory tenancy is terminated, any subtenant who has been lawfully sublet the dwelling house or any part of it is protected and becomes a direct tenant of the landlord on the same terms as the statutory tenant – provided, always, that he himself qualifies as a protected occupier or statutory tenant under the 1976 Act.85
