9 Succession to one commercial unit only
8.53 Succession is limited, on policy grounds, to one commercial unit of land from one landlord. Where an applicant obtains a tribunal direction entitling him to a tenancy of a particular holding, he is ‘deemed’ to be in occupation of that land for the purposes of the ‘occupancy’ condition.101 If the land to which he has obtained succession is a commercial unit, he will be rendered ineligible to apply for succession to further holdings elsewhere.102 If he succeeds as a joint tenant of the first holding, his ‘appropriate share’ of the income generated by the holding must be calculated for the purpose of deciding his eligibility to succeed to further tenancies.
