4 Temporary storage of waste
14.92 Waste can be stored, pending collection, for up to 12 months at the site where it was produced. The waste must be stored securely.205 The temporary storage of waste is exempt from waste management licensing requirements, and does not need a license exemption (cf.
low risk farm activities that do require the registration of a licence exemption, discussed below). Where material is stored in a dump on-farm, the 12-month period will commence from the point in time when the first waste material was deposited. After the 12 month period expires, waste must be disposed of or recovered in accordance with one of the options outlined below – for example by removal by a waste management company, or by reuse following the registration of a licensing exemption by the farmer. The duty of care will apply to ensure that, where waste temporarily stored, reasonable steps are taken by the farmer to prevent the escape of waste, and that if it is later transferred to a third party for disposal to ensure that is transferred to an authorised person.
