7 Tenancies granted to office holders
5.75 Section 1(1) of the 1986 Act excluded from the definition of an ‘agricultural holding’ any contract of tenancy ‘under which the... land is let to the tenant during his continuation in any office, appointment or employment held under the landlord’. An agricultural holding will not have been created, therefore, where a landlord appointed a manager to run his farm for him and paid him a salary or a proportion of the profits of the business.
