1 TRIG: Establishment and Terms of Reference
1.32 The need to provide an appropriate legal framework for farm diversification formed the background to subsequent legislative initiatives in relation to farm tenancy law, namely the establishment of the Tenancy Reform Industry Group (‘TRIG’) in 2002, and the implementation of its subsequent reports by statutory amendments to the Agricultural Holdings Act 1986 and Agricultural Tenancies Act 1995.53 All sectors of the farming industry were represented on the TRIG, together with professional organisations (such as the CAAV, RICS and Agricultural Law Association), local government and an independent member.
Its terms of reference54 were, consistent with government policy towards the farming industry, to (i) establish an industry consensus or propose options for tenancy reform and (ii) to make the case for the removal of fiscal disincentives, and the introduction of new incentives, to promote government policy. The government’s objectives in sponsoring further tenancy reform were identified as including inter alia: the promotion of a ‘innovative, diverse and environmentally responsible farm based businesses’; ensuring that tenant farmers can diversify where this will enhance the viability of their businesses or take steps to enhance the environment without jeopardising their tenancy (or succession rights); ensuring that holdings can be restructured without jeopardising tenants rights; maintaining the area of let land; increasing the area of land let under whole farm agreements; and facilitating restructuring and the development of a diverse and sustainable farming industry.55 In carrying out this exercise it was directed to maintain an appropriate balance between landlord and tenant interests.
