Regulation of Pro Bono
There is no general regulation of pro bono services, but there is regulation by the SRA of pro bono by in-house lawyers. This is imposed as a result of the LSA 2007, which requires that the provision of reserved legal services to the public is carried out through an authorised body. Therefore, the SRA regulations allow in-house solicitors to conduct pro bono work subject to three qualifications.197 First, the work must not be a reserved legal activity which is part of the business of the organisation employing the person donating the services. Secondly, it must be covered by indemnity insurance. Thirdly, no fees can be charged, or a conditional fee agreement must be used and any fees recovered from the other side paid to a charity under a fee sharing agreement.
