XII. The Future of Professional Bodies
It is currently unclear where the experiment with regulation of the legal professions will end. Under current arrangements, the significance of professional bodies has been reduced to a largely representative role.
This could be seen as a transition to a framework where a single regulator regulates lawyers directly, according to the activities they undertake rather than the profession in which they qualified. This might well produce different kinds of representative body, which may, or may not, look like the current professional bodies.The future of the professional bodies may depend therefore, not only on what happens in the market for legal services, but on how they react to the changing in their circumstances. Professions will need to work harder and be more effective in advocating their own value to society. They will need to build the structures and mechanisms that can help them achieve this. In effect they need to create a new role in the limited space left to them by the LSA 2007.
