Pignus (Pledge)

Pledge was a bonaefidei, bilateral contract, by which a creditor handed over prop­erty to a debtor as security for payment of a debt. As with the other real contracts, it was created by delivery of the property in question. However, in addition to the contractual aspects of pledge, there are also property issues to consider, because the creditor taking an item on a pledge acquired a real right over that item. For that reason, pledge is considered elsewhere, in Chapter 15,[2131] as part of property law along with other rights in security.
