Praedial Servitudes in Modern Law

It has already been mentioned that the Scots law on servitudes has been strongly influenced by Roman law. We have seen in particular that Roman law has in recent times been a fertile source in the development of new forms of servi­tude. This may well continue, and Roman sources may continue to prove useful more generally wherever fundamental principles of servitudes are concerned, as opposed to cases raising technical issues in the law governing court procedure or conveyancing of land.
