14.54 Increased legislative concern with controlling diffuse water pollution from agricultural sources was supplemented by the issue, of a revised Code of Good Agricultural Practice for the Protection of Water in 1991.

The Code has now been reissued as part of a composite Code for the Protection of Water, Soil and Air.111 The Code of Practice supplements and complements the precautionary measures taken in the Water Resources (Control of Pollution) (Silage Slurry and Agricultural Fuel Oil) (England) Regulations 2010112 by giving detailed guidance to farmers as to methods of containment and handling for various kinds of farm waste and effluent, with appropriate scientific information relating thereto. The Code was issued under provisions in the Water Resources Act 1991.113 The Code is advisory only, being intended to give practical guidance and to promote desirable practices for avoiding or minimising the pollution of controlled waters.114 It does not have direct legal effect and enforceability under the 1991 Act, and compliance with its terms will not constitute a defence to a prosecution under the Environmental Permitting Regulations. Its legal status is discussed below, in the context of ‘right to farm’ provisions in UK law.
