7 Dismissal of application
8.94 Where the Tribunal disposes of the nominated successor’s application other than by directing that a succession tenancy be granted, then the (unsuccessful) nominated successor is barred from applying for succession on the tenant’s later death.162 This will be the case even where a substantial period has elapsed between the Tribunal’s refusal of succession and the tenant’s later death, during which time the unsuccessful nominated successor may have become both an ‘eligible’ and ‘suitable’ candidate for succession.
