6 Landlord’s notice to quit
8.93 Any notice to quit given to the tenant – either before or after the giving of a Retirement Notice – which does not fall within the above rules is deemed by s 54 to be of no effect during the one-month period for making application for succession, or during the course of succession proceedings if application is duly made. If the Tribunal direct that succession take place, then the notice to quit has no effect. This would apply, for instance, in the case of a notice to quit given under s 26(1), where the period allowed for referring the notice for tribunal consent had not expired at the date of the retirement notice.
