8 Early resumption clauses

9.52 Section 62 applies special rules where the lease contains an early resumption clause enabling the landlord to repossess the holding for some specified use other than agriculture, on giving less than the statutory minimum notice to quit.119 Where the tenant quits in these circumstances the landlord is liable to pay an additional sum in compensation, equal to the value of the additional benefit (if any) which would have accrued to the tenant had the tenancy been terminated (as would otherwise be the case) by 12 months’ notice ending on a term date.120 The tenant’s position, for compensation purposes, is to be treated as the same as if he had been given the normal statutory notice to quit, of at least 12 months’ duration.
