13 Interaction of retirement and death provisions
8.104 Where the nominated successor obtains a tenancy following a direction under s 53, then on his subsequent death the provisions providing for succession on death will apply in the usual way. If he dies leaving close relatives, they may apply for a further transmission of the tenancy (provided two successions have not already taken place). The grant of a new tenancy to the nominated successor on retirement counts as one transmission of the tenancy for the purposes of the succession scheme on death, and also for the purposes of future applications on retirement.173
