12 Effect of direction on succession to other holdings
8.103 If the retiring tenant dies, and the nominated successor is for the time being entitled to a tenancy of the holding pursuant to a direction of the Tribunal, then he is ‘deemed’ (by s 58 of the 1986 Act) to be occupying that holding for the purposes of satisfying the occupancy condition172 in relation to any other tenancies held by the deceased. Thus, if the holding to which he succeeds on retirement is a ‘commercial unit’ of agricultural land he will be ineligible to apply for a direction entitling him to succeed to any of the other tenancies held by the deceased tenant at his death.
