postconsulates, contrary to what Seeck assumed.
Of the 41 fragments with a postconsulate (some stemming from the same basic constitution) 19 may derive from a collection made in Africa. This leaves 22 fragments which are eliminated on the basis of a hypothesis offered by the authors of CLRE. Mostly the hypothesis sounds attractive, but for the postconsulate of NTh 22.2 [443] the explanation given cannot hold. According to the authors of CLRE the (western) postconsulate is an accepto-date added in the West, after the law was dispatched late in 442. Yet this novella was sent, with others, in Oct. 447 by Theodosius to the West (see NTh 2) and their promulgation there was ordered in54 CTh 6.8.1 (6 Nov 422), 7.4.35 (14 Feb 423), 16.8.25,15.3.6 (15 Feb), 7.15.2 (7 March, 7.6.5 (9 March), 4.18.2, 11.30.67 (30 March), 11.31.9 (30 March 423 Seeck 424), 16.8.26, 16.10.22, 16.5.59, 16.9.5 (9 Apr), 8.4.28, 6.35.14 = in part 12.1.184 (18 May), 1.34.3 (31 May), 16.5.60,16.8.27,16.10.23,16.10.24 (8 June), 16.5.61 (8 Aug), 12.3.2 (9 Aug), CJust 4.63.6 (23 Aug), 8.10.11 (29 Sept 423), CTh 15.1.52 (9 Jan 424), 10.21.3 (16 Jan), 4.4.7 =

55 Consultatio 9.1-7. This attribution is open to doubt. It appears in the original edition of the Consultatio by Cujas in 1577, based on the only known source, an apograph in his possession since 1563. However, Cujas showed no knowledge of the Hermogenian attribution, when he placed all seven texts in his 1566 edition of CTh, at the same time omitting them in his assemblage of Hermogenian Code fragments. See E. Volterra, ‘Le sette costituzioni di Valentiniano e Valente contenute nella Consultatio', BIDR 3rd
59 Emendations that I do not discuss are listed here. On account of the confusions over many subscripts, I have not included every text for which one variant reading could give a theoretical Licinian provenance. The manuscript date and place are given, followed by proposed emendations with their sources in brackets. CTh 2.16.2, July 315, Naissus (319; Seeck, Regesten, p. 168).
