Quite apart from the arguments favouring the system of jury trial as the mode of a fair trial (of which there were numerous examples in the debate on 20 March 2007), two matters were advanced for advo­cating the change recommended by Lord Roskill and his colleagues in 1986, and repeated by Lord Justice Auld in his one-man review of the criminal courts in 2001.[175] In using a panel of experts in any frauds tribunal, Sir Robin highlighted numerous difficulties, includ­ing the precise role of expert members. Nevertheless the Government took the view that the better solution lay in section 43. It proceeded to legislate in 2007.
