3 Organisation of this Work

1.05 This work is organised in three Parts, to reflect its integrated coverage of the wide range of legal measures applicable to modern land tenure and land use:

•Part I gives a Historical Introduction and overview of the development of farm tenancy law, and of the principles on which the legislations is based, in Chapter 1.

Chapter 2 gives an historical introduction to the law governing land use, and an overview of the EU legislation and domestic provisions currently applicable.

•Part II describes the Law of Land Tenure, and is principally concerned with farm tenancy law. It is divided into two principal parts, to reflect the dual system of protection applicable to farm tenancies since 1st September 1995, and outlined above. Chapters 3 and 4 are devoted to farm business tenancies and the Agricultural Tenancies Act 1995. Chapters 5–10 then consider the law of agricultural holdings. Tied Cottages are considered in Chapter 11.

•Part III describes the Law of Land Use. This includes discussion of planning law in Chapter 12, and the law relating to nature conservation and pollution control on farms in Chapters 13 and 14. Chapters 15 considers the impact of European Union law on agricultural land use viz. the law governing the basic payment scheme, and relevant measures under the Rural Development programmes. Earlier editions of this work also covered the law governing dairy quotas. Dairy Quotas were abolished from the end of March 2015 under the latest CAP reform (Europe 2020), and are not covered in this work. Readers with an interest in this topic can consult Chapter 16 of the third edition, which includes detailed coverage of the former law governing milk quotas.
